By installing or using cadosy GPSR Shield (also referred to as GPSR Shield, the "App") on your Shopify store ("you", "Merchant"), you agree to these Terms. If you do not agree, do not install or use the App.
1. What the App is
GPSR Shield is a data-management and display tool for the EU General Product Safety Regulation (Regulation (EU) 2023/988, "GPSR"), specifically the Article 19 information that a merchant selling at a distance must show in a product offer. The App lets you enter, store, organise and display on your storefront product-safety information that you provide.
2. What the App is NOT
- The App is not legal advice and does not determine whether you, your products or your listings comply with the GPSR or any other law.
- The App is not a full GPSR-compliance solution. It does not perform, and does not help you perform, the obligations of manufacturers (Art. 9), importers (Art. 11), distributors (Art. 12) or online-marketplace providers (Art. 22). It addresses only the display of Article 19 information you author.
- The App does not generate legal or safety content. Every value displayed is authored, reviewed and published by you. Any optional example text is clearly labelled as an example and requires your edit and confirmation before it is used.
- "Gap detection" features highlight potential gaps in the data you entered (e.g. an empty field). They are not a legal assessment of your products and do not tell you what the law requires.
3. Your responsibilities
You are solely responsible for: (a) the accuracy, completeness, lawfulness and language of all information you enter and publish, including manufacturer / economic-operator details, product identifiers, images and warnings; (b) determining whether your products may be placed on or made available in the EU market and who your responsible economic operator is; (c) reviewing each product and explicitly publishing it (the App does not display anything on your storefront until you set it to "published"); and (d) complying with all laws applicable to your business, including the GPSR, product-specific EU legislation (e.g. CLP, toy/electrical safety), consumer-protection and data-protection law.
4. No legal advice
Nothing provided by the App or by us constitutes legal, regulatory or professional advice. You should obtain your own qualified legal counsel regarding your GPSR obligations.
5. Service provided "as is"; no warranty of correctness
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the App or its output is accurate, complete, error-free, or sufficient for legal compliance. We do not warrant uninterrupted or secure operation, or that the App reflects the current state of the GPSR or any other law.
6. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, regulatory fines or penalties, or business interruption, arising out of or related to the App. Our total aggregate liability for all claims arising out of or related to the App and these Terms is limited to the greater of (i) the total fees you paid us for the App in the twelve (12) months before the event giving rise to the claim, or (ii) USD 100.
Some jurisdictions do not allow certain exclusions or limitations; in that case the above applies to the maximum extent permitted. Nothing in these Terms limits liability that cannot be limited by law (e.g. for gross negligence, wilful misconduct, or death/personal injury where applicable).
7. Indemnification
You will defend, indemnify and hold us harmless from and against any third-party claims, damages, liabilities, fines, costs and expenses (including reasonable legal fees) arising out of or related to (a) information you entered, published or displayed through the App, (b) your products or your business, or (c) your breach of these Terms or of any applicable law.
8. Data protection
Our handling of personal data is described in the Privacy Policy (https://gpsr-shield.vercel.app/privacy) and, where we process personal data on your behalf, the Data Processing Addendum (https://gpsr-shield.vercel.app/dpa), which is incorporated into these Terms. You are the controller of the personal data you enter (including economic-operator contact details and reviewer identities) and are responsible for having a lawful basis to process and publicly display it.
9. Fees, plans and billing
Paid plans are billed through Shopify Billing on the terms shown in the App and on the App Store listing. Fees are non-refundable except where required by law. We may change plans or pricing prospectively with reasonable notice.
10. Suspension and termination
You may uninstall the App at any time. We may suspend or terminate access for breach of these Terms or misuse. On termination, your data stored in Shopify (metafields/metaobjects) remains in your store; see the Privacy Policy / DPA for deletion of any data we hold.
11. Changes to these Terms
We may update these Terms; material changes will be notified via the App or cadosy@gmail.com. Continued use after changes take effect constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of Republic of Korea, without regard to conflict-of-laws rules. The exclusive venue for disputes is the courts of the Republic of Korea having jurisdiction over the Provider's principal place of business (Goyang-si, Gyeonggi-do). This choice does not deprive you of mandatory consumer protections of your country of residence where those apply.
